作者針對女性勞工為對象的司法院釋字八○七號解釋進行簡要評價，期望在該號解釋公告之後可減少公會的抵制，進而藉程序正義而有正當的情緒發抒，並增進一般公民參與公共事務的一種賦能使命感。本篇論文旨在：1.性別平等保護的正負面向功能2.瞭解這號解釋之方法論論證訴求。本文採法規範研究途徑為軸心，內容解析現存法律及釋憲機關對勞工利益的見解，進而瞭解正當法律手續對工作權之影響。

The author concern female workers equal protection issue in Taiwan area. this paper hopes of Judicial Yuan Interpretation No.807 can reduce the union organization resistance, providing a procedure justice for them express and feel a sense of empowerment in public affairs. The aim of this article was to (1) discuss the sexual equal protection with this institution produced function and dysfunction. (2) Understanding No.807 in the legal methodology of appeal to reasoning. The legal approach was used as descriptive clause content, which was based on the existence law and constitutional court decision so as to know the effect of due process of law to the right of work.
