美國司法制度極其繁複'且富於特色，各種法院之組織、任務、通作及對社會政治之影響如何，值得深入研究。為達此目的，勢須對聯邦與各州法院之間關係、組織、職權、行政管理、實際運作、司法審查、近年司法改革情形及其動向等層面，加以探討。同時對法官、檢察官及法院其他重要輔助人員之人事制度，包含如何任、免、待遇、懲戒、訓練等一併用較新資料作動態性之探究。力謀理論與實務並重，俾作為改進我國司法制度之考鏡。

Itis beyond all doubts that American legal system has many features and
exerts great influence upon our present legal system. This paper purports to analynize many important facets of the courts， including their organization， operation， especially the role played by the federal Supreme Court and their social and political impact upon American society so as to be used as reference of reform for our pertinent system. In order to achieve this purpose， those related questions such as selection， removal， discipline， compensation， as well as training of judges， district attorneys and some other judicial officials are arso explored. Equal emphasis are placed upon both theory and practice.
