具有市場壟斷性的專利，因為能為企業創造營收與可觀利潤，而成為企業積極保護原創知識的重要手段。根據世界智慧權財產組織的報告指出，若能善用專利公開的資訊，不但可縮短60%的研發時間，更可節省將近40%的研發經費；這兩方面，都凸顯了專利在知識經濟時代與智慧財產權中的特殊地位。目前台灣經核准的專利所顯示的最大問題在於量遠勝於質，而「如何衡量專利的品質」，至今卻尚未有合適的答案。目前常用的專利數量與專利趨勢等，皆為「量」的指標分析，在功能上仍有所不足。若要有所突破，必先對專利的品質與專利的價值有更準確與清楚的認知。同時，專利的價值與產業特性、消費者需求、產品價格及效能、競爭者等因素息息 相關，亦顯示產業研究、專利分析及價值 衡量的密切性。 本文的貢獻有二：(1)由產業研究引領 專利價值分析的展開；(2)在「專利的價值 = 發明的品質專利說明書撰寫的品質 發明的市場價值」的架構下，探討專利品 質與價值的提升之道。

Patent monopoly helps companies generate more revenue and profit. Firms usually use patent to protect their invention. A report by World Intellectual Property Organization (WIPO) indicated that a good use of patent information would not only reduce a company’s R&D time by 60%, but it also cuts R&D expense by 40%. In a knowledge-based economy, patent distinguishes itself among various intellectual property rights. Taiwan has long boasted its quantity of patents granted in the U.S. every year. But the quality of those patents is less impressive. In Taiwan we know how to do quantitative patent analysis quite well, but this is far from enough.We have difficulty in measuring patent quality because of ignorance of it. It is imperative for us to have a good understanding of the context of patent quality before we can measure it properly. Patent analysis tends to have a close relationship with industrial research. And patent value depends on industrial feature, user needs, price & performance, the number of competitors and competitors’ capability. This paper proposes a method for patent analysis guided by industrial research. And based on the formula “patent value = the quality of utility patent × the quality of patent application document×the market value of utility patent”, we can discuss and improve the quality of utility patent and the patent value.
