硏究機構、大學與產業界之密切結合，構成高效率之創新網路，以加速 智慧財產之創造、取得、累積與運用，以協助產業提升競爭力，是許多國家政 府重要之科技政策。我國自1999年開始實施科技基本法以來，已有7所大學 設立技術移轉組織，財團法人硏究機構亦積極調整組織與策略，以利智慧財產 之推廣。本硏究之目的即在於分析國內外大學、硏究機構之技術移轉單位之組 織特性、專利策略及技術移轉措施，了解其運作方式與績效，以供相關單位建 立學習標竿之參考。 本硏究發現技術移轉組織大都屬於機構內之一級單位，以利溝通與協 調，但爲配合產業環境及組織運作之需要，有些機構以公司、法人之型態或由 外界之技術管理公司經營之。而最値得學習的是美國之專利策略、授權方式之 多元化、技術移轉人員之高度專業化，以及協助新創企業成立、發展之週遭環 境。而德國FhG、MPG荷蘭之TNO以及澳洲之CSIRO等對於新創企業之協 助亦値得參考。工硏院之專利數量比美國大部份之大學、硏究機構多，授權收 入可以比美美國一流大學，但技術與專利未分開計價，純專利授權成果未顯 現。在長期整體性發展上國內硏究機構與大學宜加強建立以智慧財產爲中心之 技術移轉機制，強化專利策略、授權策略之運用，晉用資深及長期培育技術移 轉專才。

The research institutes 、universities and industries form a highly efficient innovation network to accelerate the knowledge creation 、 acquisition、accumulation and application is one of the government most important measures for up- grading the industrial competitiveness. In Taiwan, there are several universities have already set up their technology transfer offices and research institutes also adjust their organization structure and strategies to promote their research results. In order to benchmark, the study analyzed the practices and performances of the technology transfer of research institutes and universities both in domestic and abroad. The study finds that most of the Technology License Offices (TLOs) of institutes and universities are set up with first rank organizational hierarchy, supervised by vice president, whereas some TLOs are independent companies or non-profit organization. The patent and license strategies and the infrastructure of start-up companies of the American universities are worth learning. CSIRO, FnG and MPG also have incentive programs to promote new start-up companies, which are also valuable. .ITRI own patents are more than that of the most American universities ,licensing income is as good as American famous universities, but most of the income from know how, so far pure patent licensing performance is not good enough. Research institutes and universities of Taiwan may strengthen the IP licensing mechanism, enhance patent and license strategies, as well as recruit and cultivate technology professionals
